1. If I think the motorcycle or auto accident was my fault, should admit it?

Do not volunteer any information about who was to blame for the accident. You may think you are in the wrong and then learn that the other driver is as much or more to blame than you are. You should first talk to your insurance agent, your lawyer or both. Anything you say to the police or the other driver can be used against you later. Only answer what you know and do not speculate as you explain your side with a police officer.  Stick to facts.


2. What information should I save at the scene of a motorcycle or auto accident?

Get all basic information and save any police reports.  Take pictures of property damage, injury and location of the accident if you have a camera handy.

Get the names, addresses, telephone numbers and insurance companies of each vehicle involved.  Photograph skid marks and consider measuring them if you can do this without endangering yourself.

3.  What if I get a cited with a violation of the law?

A traffic ticket is not determinative of your guilt or innocence. In fact, most of the time it is not even admissible in court.  You should sign the citation because under Florida law, it is a crime to refuse to sign a traffic citation.  Consider contesting the ticket and asking your lawyer how to handle the hearing.  It may affect your chances of a pre-litigation settlement if you plead guilty.

4. If I have a motorcycle or auto accident, do I have to stop?

You should always stop and pull your vehicle over if you are in an accident in Florida.  It can be a crime to leave the scene of an accident, especially if there are injuries or property damage.

5. Do I need motorcycle or auto insurance?

Florida law requires that every driver and vehicle owner have insurance for Personal Injury Protection of $10,000 for lost wages and necessary medical treatment at a minimum.  However, it is very important to protect yourself against uninsured or underinsured drivers by purchasing UM (uninsured motorist) Coverage.  It is great coverage for the premium paid. Additional coverage should be obtained for liability (injury of other people) and collision (property damage coverage) to be safe.

8. Should I see a doctor or visit the hospital after a motorcycle or auto accident?

If you feel you are injured, you should put your health first.  Also, it is important to document your injury soon after an accident.  If you put up with pain and avoid documenting your incident and related injury, it may be more difficult to prove your case.  It's possible your pain will set in a day or two after an accident.  Be aware of this and consider seeing your family doctor and explain the details of the accident and your exact condition.
